Subscription terms, pricing, and billing frequency will be specified in your individual service agreement. All fees are non-refundable unless otherwise stated in writing. We reserve the right to modify pricing with reasonable prior notice to existing subscribers.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we shall not be liable for any such changes.
To the maximum extent permitted by law, Evenware shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability to you in respect of any losses arising from your use of the Service shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.
You agree to defend, indemnify, and hold harmless Evenware and its directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We reserve the right to modify or replace these Terms at any time. We will provide reasonable notice of any significant changes. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
